Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Stuffed mobile application and the website at stuffedfoodtruckfinder.com (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
Stuffed helps people discover food trucks and related locations on a map, view menus and photos, leave reviews, and save favorites. Truck owners may create accounts, upload content, and broadcast their location in real time. Stuffed provides information and tools only. We do not operate the food trucks listed in the app, prepare food, or process payments for food purchases.
2. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian. The Services are not directed to children under 13.
3. Accounts
You may need an account to use some features. You are responsible for the accuracy of information you provide and for keeping your login credentials confidential. You are responsible for activity under your account. Notify us promptly at support@stuffedfoodtruckfinder.com if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms or that create risk for other users or the Services.
4. Location and broadcasting
Some features require access to your device location. Customers who allow location access can see nearby trucks. Owners who choose to broadcast share their live location with other users while broadcasting is on. You control broadcasting in the app and location permissions in your device settings. Location data may be imperfect; do not rely on it as the sole source of safety or navigation information.
5. User content
You may submit content such as reviews, photos, menus, profile information, and messages (“User Content”). You retain ownership of your User Content. By submitting it, you grant Stuffed a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that User Content as needed to operate and promote the Services.
You represent that you have the rights needed to submit User Content and that it does not violate law or anyone else’s rights. You agree not to post content that is illegal, harmful, deceptive, infringing, harassing, or otherwise inappropriate. We may remove User Content or restrict accounts at our discretion.
6. Acceptable use
You agree not to:
- Misrepresent your identity, affiliation, or a truck’s status, menu, or location.
- Interfere with or disrupt the Services, attempt unauthorized access, or scrape the Services in a way that harms performance or violates these Terms.
- Use the Services to spam, harass, or send unsolicited commercial messages outside features we provide.
- Use another person’s account without permission.
- Reverse engineer or attempt to extract source code from the app except where applicable law allows.
7. Third-party services and trucks
The Services may use or link to third-party services such as map providers and hosting or authentication providers. Your use of those services may be subject to their terms. Food trucks and food parks listed in Stuffed are independent businesses. Stuffed is not responsible for their food, prices, hours, hygiene, safety, or conduct. Any purchase or interaction with a truck is solely between you and that truck.
8. Intellectual property
The Services, including the Stuffed name, logo, and app design, are owned by Stuffed or its licensors. Except for the limited rights needed to use the Services, no rights are granted to you. You may not copy, modify, or distribute our branding or software except as allowed by these Terms or applicable law.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUFFED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that listings, locations, menus, or reviews are accurate, complete, or up to date, or that the Services will be uninterrupted or error-free.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUFFED AND ITS OPERATORS, CONTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50). Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
11. Indemnity
You agree to defend and indemnify Stuffed and its operators against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Services, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Services at any time and may request account deletion through the app or by emailing support@stuffedfoodtruckfinder.com. We may suspend or end access to the Services at any time, including for violations of these Terms. Sections that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnity) will survive termination.
13. Changes
We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date. Continued use after changes become effective constitutes acceptance of the revised Terms.
14. General
These Terms are the entire agreement between you and Stuffed regarding the Services and supersede prior agreements on the same subject. If a provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, sale, or similar transaction.
